With PCTs
Disputes with the PCT can arise in many aspects of a dentists business and not just from the contract with the PCT. The contract itself should contain dispute resolution procedures and it is important that local resolution is exhausted before referrals are made to the NHSLA for determination.
Local resolution can be the start of a lengthy process and we would advise dentists and dental care professionals to seek legal advice at an early stage. Where the dispute cannot be resolved at local level, there is likely to be the opportunity to make a formal referral to the NHSLA for dispute resolution. Legal action may also be available where the contract is a legal contract.
Lockharts are experienced in assisting clients throughout this process and understand the importance of correctly presenting your request and supporting materials. We are happy to prepare applications to the NHSLA or review and advise on draft applications to ensure that the chances of success are maximised.
Partnership
We always encourage our clients to take appropriate measures to limit the likelihood of disputes arising. However, invariably some practices will at some point find themselves faced with a dispute involving partners and/or employees.
We can help with: negotiations and settlements when partners retire voluntarily or compulsorily; advice on internal partnership disputes, dissolutions and expulsion of partners; acting on behalf of partnerships and individual partners in ADR, mediation, arbitration and court proceedings; and advising on the enforceability of restrictive covenants, including acting to obtain injunction applications.
If you would like some advice or assistance with any of the above please complete our enquiry form and someone from our Team will contact you.
